1.2. For the purposes of these Terms:

User: a natural person who uses the Portal with or without registering.
Registered User: a User who has a user account on the Portal.
Consumer: a natural person acting outside the scope of their trade, independent occupation or business.
Service: the free digital service provided through the Portal, in particular organising and recommending external learning materials, creating personalised learning paths and tracking the progress of registered users.
Learning material: educational content recommended on or made available through the Portal, or a link to educational content provided by a third party.
2. Scope and acceptance of the Terms
2.1. These Terms set out the conditions for using the Service provided through the Portal.
2.2. Some functions of the Portal are available without registration, while others, in particular access to certain learning materials, tracking learning progress and keeping the data linked to the user account, require registration or signing in.
2.3. A contractual relationship of indefinite duration, free of charge, for the use of the Service is established between the Registered User and the Service Provider when the Service Provider confirms the registration.
2.4. During registration the User makes a separate declaration accepting these Terms. Before registration, the Service Provider makes the Terms available in a form that can be read, downloaded and stored. Acceptance takes place before the registration is finalised, by means of a separate checkbox that is not ticked in advance, including the first registration with a Google account.
2.5. The provisions of these Terms on use apply accordingly to the functions available without registration. Merely viewing the Portal does not in itself constitute concluding the contract for the registered user service.
2.6. These Terms have been drawn up in Hungarian. If the Portal is also available with an interface in another language, the Service Provider also provides the information needed to conclude the contract in that language, where it allows the contract to be concluded in that language.
2.7. Before registration, the Service Provider informs the User clearly and comprehensibly of the main characteristics of the Service, that it is free of charge, its technical requirements, the duration and termination of the contract, and the consumer's right of withdrawal and termination.
2.8. After registration has been completed, the Service Provider confirms the conclusion of the contract by email and provides the User with the Terms in force at the time the contract was concluded, together with the information on the consumer's right of withdrawal and termination and the model form.
2.9. Consumers are entitled to the rights under Government Decree 45/2014 (II. 26.) and the legislation applicable to digital services. Accepting the Terms does not constitute consent to data processing under the GDPR.
2.10. For the functions available without registration, in particular the AI-based recommendation of learning materials, the Service Provider ensures on its website that the Terms and the Privacy Notice are continuously, easily and directly accessible. Use without registration does not involve creating a user account.
3. Content of the Service; free of charge
3.1. The primary purpose of Nitro Campus is to support Users in broadening their professional knowledge, finding relevant educational content and planning their learning.
3.2. The Portal may in particular provide the following functions:
a) organising and recommending educational content and learning materials;
b) personalised recommendation of learning materials and creation of a learning path based on a questionnaire;
c) creating and managing a user account;
d) saving learning materials and recommendations;
e) tracking learning progress;
f) access to certain learning materials on the basis of registration or signing in;
g) receiving error reports, comments and suggestions for improvement.
The Portal serves to collect, organise and recommend learning materials and to support the User's independent learning. Within the Portal, the Service Provider does not organise or hold education or training, does not conduct examinations and does not issue certificates of completing training. The use of learning materials recommended on the Portal and provided by third parties is governed by the terms of the providers concerned.
3.3. The Service is free of charge for Users. The Service Provider charges no registration, subscription or other service fee for using the functions of the Portal under these Terms. The User has no payment obligation towards the Service Provider; the Service being free of charge does not affect the consumer's statutory rights.
3.4. The range, content and access conditions of the learning materials available or recommended on the Portal may differ. Not all learning materials are available without registering or signing in.
3.5. Where a learning material is available on a third party's website or service, its use may be subject to the third party's own terms of use. Any registration or payment that a third party may require is not part of the free Service provided by the Service Provider. The external provider concerned gives information on such terms.
3.6. The Service Provider may develop, update and, where justified, modify the Portal's recommendations of learning materials and its functions, while respecting the statutory rights of Users.
4. Registration and user account
4.1. Registration on the Portal can be completed using the registration procedure available or, where the function is available, by identification with a Google account.
4.2. During registration the User must provide the required data truthfully and must adequately protect the access credentials they use.
4.3. During the registration process, the User must be given the opportunity to check the data they have entered and to correct any input errors.
4.4. The Service Provider confirms receipt of the declaration of registration electronically. The contract is concluded upon confirmation that the registration has been completed successfully and the user account has been created. The confirmation contains on a durable medium, or provides as attachments, the Terms in force at the time the contract was concluded, the mandatory consumer information and the model termination form.
4.5. The User is responsible for ensuring that their access credentials cannot be used by unauthorised persons. If unauthorised access is suspected, the User must take the security measures available to them and, where necessary, notify the Service Provider.
4.6. Signing in with a Google account uses the external identification service provided by Google. Google is responsible for the operation and terms of its own service.
4.7. The user account is for personal use. The User may not access another person's account without permission or endanger the operation or security of the Portal.
5. Personalised recommendation of learning materials and artificial intelligence
5.1. The Portal allows the User to request a personalised recommendation of learning materials by completing a questionnaire and providing information on their professional background, interests, experience and learning goals.
5.2. The personalised recommendation of learning materials is an optional function. Completing the questionnaire is not a condition for using the other functions of the Portal.
5.3. Technology based on artificial intelligence is involved in preparing the personalised recommendations. For this purpose the Portal uses the Claude model available through the Amazon Bedrock service.
5.4. The recommendation of learning materials created by artificial intelligence is informative and meant to support learning. It is not an official assessment of the User's qualifications, professional aptitude or level of knowledge. The data processing within the recommendation function is separate from any processing for recruitment purposes under point 12.5 carried out on the basis of the User's separate consent.
5.5. Recommendations are prepared on the basis of the information provided by the User and the technology used. The Service Provider strives to make them relevant but does not guarantee that every recommendation will be complete, error-free or suited in every respect to the User's individual goals.
5.6. The User may depart from the recommendations and may freely choose from the learning materials available to them on the Portal, in line with their access conditions in force at the time.
5.7. In the free-text fields of the questionnaire, the User must refrain from providing personal data not needed for the recommendation, personal data of other persons, and special categories of personal data.
5.8. The processing of personal data in connection with AI-based recommendations is governed by the Privacy Notice.
6. Learning materials, external links and intellectual property
6.1. Texts, software components, graphic solutions, databases and other content appearing on the Portal that the Service Provider has created or lawfully uses may be protected by copyright or other intellectual property rights.
6.2. The User may use the content of the Portal only in line with the purpose of the Service, for their own learning and information, within the limits of the law and of any terms of use indicated.
6.3. These Terms do not transfer any copyright or other intellectual property right to the User.
6.4. Learning materials, trademarks, signs and other content provided by third parties and available on the Portal may be the property of the right holders concerned. Their use is subject to the terms of the right holder concerned.
6.5. The Portal may also contain links to third parties' educational websites and services. The Service Provider does not continuously monitor the content, availability and operation of such external sites and may not be able to influence changes to them.
6.6. The Service Provider undertakes no obligation that all learning materials of external providers will remain continuously available, unchanged in content or free of charge.
6.7. The Portal collects, organises and recommends educational content published by third parties, providing Users with links to the websites of the original content providers. The Service Provider does not store or copy the linked learning materials and does not make them available as its own service. The use of external learning materials is subject to the content providers' own terms of use.
7. The User's obligations
7.1. The User must use the Portal as intended, in accordance with the law in force and these Terms.
7.2. In particular, the following are prohibited:
a) deliberately obstructing or overloading the operation of the Portal or endangering its security;
b) attempting unauthorised access to another user account or to the Portal's non-public systems;
c) transmitting malware, harmful code or content that endangers the operation of the Portal;
d) unlawfully copying, distributing or using the content of the Portal;
e) infringing the rights of other persons, in particular their personality, data protection or intellectual property rights;
f) abusive automated use contrary to the purpose of the Portal.
7.3. The User is responsible, within the limits of the law, for the content of the text they provide through the Portal.
8. Availability and modification of the Service
8.1. The Service Provider strives to ensure that the Portal operates securely and continuously, but does not undertake uninterrupted or error-free availability.
8.2. The operation of the Portal may be temporarily restricted due to maintenance, development, technical faults, security incidents, disruptions at external providers or other justified circumstances.
8.3. The Service Provider may make the changes necessary for the operation, security, legal compliance or development of the Portal. It provides the updates necessary for conformity with the contract, including security updates, in accordance with the law. For changes going beyond what is required for conformity with the contract, the consumer may not be charged any additional cost; the Service Provider informs the consumer of the reason, nature and timing of the change and of any right to terminate in accordance with Section 27 of Government Decree 373/2021 (VI. 30.).
8.4. The Service Provider informs Registered Users in good time if the Service as a whole is discontinued.
8.5. The Service Provider provides the digital service in accordance with the requirements laid down in the contract and by law. In the event of non-conforming performance, the consumer may, under the conditions laid down by law, demand that the service be brought into conformity or terminate the contract.
8.6. On termination of the contract, Section 25 of Government Decree 373/2021 (VI. 30.) applies to content other than personal data that the consumer provided or created, and the GDPR and the Privacy Notice apply to personal data.
9. Liability
9.1. The Service Provider provides the Portal as a service for information purposes.
9.2. The recommendations of learning materials, learning paths and AI-based results found on the Portal are not a professional qualification, a document certifying the completion of accredited training, or official professional advice.
9.3. The Service Provider does not guarantee that by using the Portal the User will achieve any particular professional result, qualification, examination result or employment opportunity.
9.4. The Service Provider is liable in connection with the operation of the Portal and the Service it provides in accordance with the law in force.
9.5. Services provided by third parties are subject to the terms of the provider concerned. This does not affect the Service Provider's statutory liability in connection with its own activities.
10. Closing the user account
10.1. The Registered User may stop using the Portal at any time and request that their user account be closed.
10.2. Closing the user account may be initiated by a request sent to the Service Provider's email address given in point 1. The account may be closed independently of the right of withdrawal or termination under point 11.
10.3. The Service Provider may restrict access to the user account where justified, in particular in the event of a serious breach of contract, unauthorised use or activity endangering the security of the Portal. The restriction must be proportionate, and the Service Provider informs the User of its reason, unless this would jeopardise the purpose of the measure or compliance with a legal obligation.
10.4. In the event of a serious or repeated breach of contract, the Service Provider may terminate the contract with appropriate reasons, while respecting the rights to which the User is entitled.
10.5. The Service Provider closes user accounts that have been inactive for at least two years. The period of inactivity is counted from the last sign-in. The processing and deletion of the related personal data are governed by the Privacy Notice.
10.6. When the account is closed, access to the services linked to the account ends. The deletion and any further retention of the related personal data are governed by the Privacy Notice. Closing the account does not affect the User's statutory rights to access data and retrieve content. The termination of the contract does not affect the claims and rights to which the User is entitled by law.
11. The consumer's right of withdrawal and termination
11.1. A Registered User who is a consumer has the right to withdraw from the contract without giving any reason within 14 days of the day on which the contract was concluded. If performance of the Service begins within that period, the consumer may exercise a right of termination without giving any reason under the conditions laid down by law.
11.2. Withdrawal or termination may be exercised by an unequivocal statement sent to info@nitrowise.com or to the postal address given in point 1. The consumer may use the model form in Annex 1 but is not obliged to.
11.3. The right is exercised in time if the consumer sends their statement before the 14-day period expires.
11.4. The Service Provider provides on the Portal an easily accessible online withdrawal function that meets the legal requirements, and confirms receipt of a statement submitted through it on a durable medium without undue delay.
11.5. Withdrawal or termination ends the contract concerned. The Service Provider ends access to the account; the processing and deletion of personal data are governed by the Privacy Notice and the law.
11.6. As the Service is free of charge, the consumer has no payment obligation towards the Service Provider as a result of withdrawal or termination, and no monetary consideration is refunded.
11.7. The 14-day right does not affect the possibility of closing the account later under point 10.
11.8. With regard to the one-off digital recommendation function used without registration, consumer rights may be exercised having regard to the nature of the service and the statutory conditions; the Service Provider does not exclude these rights on the ground that the service is free of charge.
12. Data processing and cookies
12.1. The Service Provider processes personal data in connection with the use of the Portal in accordance with the Privacy Notice in force at the time.
12.2. The Privacy Notice describes in detail, in particular, the data processing conditions of registration, the user account, the personalised recommendation of learning materials, the AI service and error reports.
12.3. The Portal uses cookies and similar technologies, which are described in detail in point 6 of the Privacy Notice.
12.4. Accepting these Terms does not constitute general consent to the processing of personal data. For processing based on consent, the Service Provider, where it carries out such processing, asks for separate consent that meets the legal requirements.
12.5. On the basis of the User's separate, voluntary consent, the Service Provider may also process, for recruitment purposes, personal data provided while using the Portal or generated in connection with the User's activity on the Portal, in particular data on their professional interests, experience, learning goals, learning activity and progress, and, taking these into account, may contact the User about possible job opportunities.
The detailed conditions of processing for recruitment purposes, in particular the data concerned and the purpose, legal basis and duration of the processing, as well as the data subject's rights, are set out in the Privacy Notice.
Giving consent is not a condition for using the Service; refusing or withdrawing it does not affect the User's contractual rights or their ability to use the Portal. Consent may be withdrawn at any time.
12.6. The Service Provider may offer Users a voluntary newsletter subscription by means of a separate checkbox that is not ticked in advance. Subscribers may receive information by email about new content added to the Portal, news and related events. The Service Provider does not send newsletter notifications about learning progress. Subscribing is not a condition for using the Service, and consent may be withdrawn at any time, free of charge, using the unsubscribe link in the newsletter or at the Service Provider's email address. The details of the processing are set out in the Privacy Notice.
13. Contact, error reports and complaints
13.1. The User may send questions, error reports and comments concerning the operation of the Portal, as well as consumer complaints, to the Service Provider at:
Email: info@nitrowise.com
Postal address: 1117 Budapest, Gábor D. u. 4., Infopark C. ép., Hungary
13.2. The Service Provider investigates consumer complaints in accordance with the applicable law. It answers a written consumer complaint in writing, on the merits and in a verifiable manner within 30 days of receipt, unless the law sets a different deadline.
13.3. If a complaint is rejected, the Service Provider gives reasons for the rejection and informs the consumer in writing of the authority or conciliation board procedures available, providing the contact details and other information required by law.
13.4. The Service Provider keeps written consumer complaints and a copy of its reply on the merits for three years.
13.5. A User who is a consumer may, where the statutory conditions are met, turn to an authority or a conciliation board to settle a consumer dispute with the Service Provider.
13.6. The consumer may also turn to the competent consumer protection authority or to a court, under the conditions laid down in the applicable law.
13.7. The handling of consumer complaints under this point does not affect the exercise of the data subject's rights concerning the processing of personal data, which are governed by the Privacy Notice.
14. Amendment of the Terms
14.1. The Service Provider may amend these Terms unilaterally, in particular if the functions of the Portal, the content of the Service, the legal environment or the technical operation change.
14.2. The Service Provider publishes the version of the Terms in force at any time on the Portal in a way that is continuously accessible and can be downloaded and stored.
14.3. Amendments that only clarify, are administrative or do not adversely affect Users may take effect at the time indicated in the publication.
14.4. The Service Provider informs Registered Users in advance and in an appropriate manner of material contractual amendments that affect them. For amendments that require the User's consent under the law or the contract, the Service Provider obtains the appropriate consent.
14.5. An amendment of these Terms does not in itself change the legal basis for the processing of personal data.
15. Final provisions
15.1. These Terms are governed by Hungarian law, without prejudice to the mandatory legal protection to which consumers are entitled.
15.2. Matters not regulated in these Terms are governed in particular by the applicable provisions of Act V of 2013 on the Civil Code, Act CVIII of 2001, Act CLV of 1997, Government Decree 45/2014 (II. 26.) and Government Decree 373/2021 (VI. 30.).
15.3. If any provision of these Terms is invalid or unenforceable, this does not in itself affect the validity of the other provisions.
15.4. These Terms take effect upon publication on the Portal, on the effective date given above.
